1. About These Terms

These Terms and Conditions (“Terms”) govern your use of our website at jkdampproofing.co.uk and any services you request from JK Damp Proofing Services (“we”, “us”, “our”), operated by James Kirk of 105 Boxley Drive, West Bridgford, Nottingham NG2 7GN, United Kingdom.

By using our website or requesting our services, you agree to these Terms. If you do not agree, please do not use our website or engage our services.

These Terms are governed by the laws of England and Wales and comply with applicable consumer protection legislation including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

2. Using Our Website

Our website is provided for information about our services and to enable you to contact us. You agree to use it only for lawful purposes and in a way that does not infringe the rights of others.

We reserve the right to suspend or withdraw access to our website at any time without notice for operational or maintenance reasons.

3. Enquiries and Information Requests

Submitting an enquiry, contact form, quote request or callback request through our website does not create a contract between us. It is an invitation for us to make contact and, where appropriate, arrange a survey or provide a quotation.

Information provided on our website about services, treatments and timescales is provided for general guidance only and may vary depending on the specific circumstances of each property and job.

4. Surveys, Inspections and Estimates

Before undertaking remedial work, we may carry out an inspection or survey of your property. The purpose of a survey is to identify the nature and extent of any damp problem so that we can recommend and quote for appropriate treatment.

An initial survey or estimate does not in itself create a contract. Details of any fee for a survey will be agreed with you before the survey is carried out.

You are responsible for providing accurate information about your property and ensuring we have safe and reasonable access to all areas that need to be inspected.

5. Quotations

Written quotations are provided based on the information and conditions observed at the time of the survey or inspection. Quotations are valid for [CONFIRM VALIDITY PERIOD WITH BUSINESS OWNER] from the date of issue unless otherwise stated in writing.

A quotation is not a binding contract. A contract is only formed when we have accepted your written or verbal instruction to proceed and either party has taken steps to commence the agreed work.

6. Hidden Defects and Conditions Discovered During Work

Damp problems can sometimes conceal underlying structural issues, rot, fungal decay or other defects that are not visible or apparent until work begins. Where such conditions are discovered after work has started, we will:

  • Notify you as soon as reasonably practicable
  • Explain the nature of the additional issue found
  • Provide a revised or supplementary quotation for any additional work required

We will not carry out additional work beyond the original scope without your prior authorisation. You are not obliged to accept any variation and may ask us to stop work, in which case you remain liable for the cost of work properly carried out to that point.

7. Customer Responsibilities

You agree to:

  • Provide safe, reasonable and timely access to your property at agreed times
  • Ensure that the area in which work is to be carried out is cleared of furnishings, personal belongings and obstacles, unless otherwise agreed
  • Disclose any known hazards at the property (such as asbestos, lead pipework, or electrical issues in the affected area)
  • Inform us of any third-party consents required (for example, landlord or freeholder permission) before work begins
  • Follow any aftercare or maintenance instructions we provide on completion of the work

If access is not available at the agreed time and reasonable notice was not given, we reserve the right to charge for time and reasonable costs incurred as a result of an abortive visit.

8. Pricing, Deposits and Payment

All prices quoted are in pounds sterling (GBP) and, unless otherwise stated, are exclusive of VAT (where applicable).

A deposit of [CONFIRM DEPOSIT PERCENTAGE OR AMOUNT WITH BUSINESS OWNER] may be required before work commences on certain jobs. Details will be set out in your written quotation.

We reserve the right to charge statutory interest on overdue invoices under the Late Payment of Commercial Debts (Interest) Act 1998 where applicable.

9. Variations and Additional Work

Any change to the agreed scope of work must be authorised by you in advance. Where additional work is agreed, we will provide a supplementary price before proceeding. Agreed variations will be added to the final invoice.

10. Events Outside Our Control

We will not be liable for delays or failures in performing our services caused by events beyond our reasonable control, including but not limited to severe weather conditions, supply chain disruptions, industrial action, or acts of God. We will notify you as soon as reasonably possible if such circumstances arise and will use reasonable endeavours to reschedule work at the earliest available opportunity.

11. Cancellation and Consumer Rights

If you are a consumer and the contract was concluded away from our business premises (for example, at your home during a survey visit) or by telephone or online, you may have a right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

The cancellation period is 14 calendar days from the date the contract is formed. If you wish to cancel, please notify us in writing (by email or post) before the cancellation period expires.

If you ask us to begin work during the cancellation period and you later exercise your right to cancel, you may be required to pay for any services already performed. If work has been completed in full within the cancellation period with your express agreement, you lose the right to cancel.

Nothing in these Terms affects your statutory rights as a consumer under the Consumer Rights Act 2015, including your right to services that are performed with reasonable care and skill, in a reasonable time, and at a reasonable price (where not pre-agreed).

12. Workmanship and Guarantees

We carry out all work with reasonable care and skill in accordance with good industry practice and, where applicable, the relevant British Standards and Codes of Practice.

The specific guarantee period and conditions for each type of work will be set out in your written quotation or a separate guarantee document provided on completion. The guarantee is non-transferable unless stated otherwise in writing.

Guarantees are subject to your following any maintenance or aftercare instructions provided. A guarantee will not cover damage or defects caused by structural movement, flooding, third-party interference, or failure to maintain the property adequately.

Insurance-backed guarantees

Insurance-backed guarantees may be available on certain treatments. Where offered, full terms are set out in the separate guarantee documentation. We make no representations or warranties beyond those contained in any written guarantee document actually issued to you.

We will acknowledge your complaint promptly and aim to resolve it within a reasonable timescale. If we cannot resolve the complaint to your satisfaction, we will explain the options available to you.

14. Liability

We do not seek to exclude liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.

Subject to the above, our total liability to you in connection with any contract for services shall not exceed the total amount paid by you for the specific services giving rise to the claim.

We are not liable for indirect, consequential or special losses, including but not limited to loss of profit, loss of business, or loss of opportunity, whether arising in contract, tort (including negligence) or otherwise.

We accept no liability for damage to property that arises as a result of pre-existing or concealed conditions not disclosed to us before or during the survey.

15. Intellectual Property

All content on our website, including text, images, logos and design, is owned by or licensed to us and is protected by copyright and other intellectual property rights. You may not reproduce, distribute or use any content from our website without our prior written permission.

16. Third-Party Links

Our website may contain links to third-party websites, including Checkatrade and WhatsApp. These links are provided for your convenience only. We have no control over the content or practices of third-party websites and accept no responsibility for them. Visiting a third-party website is subject to that site's own terms and privacy policy.

18. Governing Law

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales. You agree to submit to the exclusive jurisdiction of the courts of England and Wales.

We may update these Terms from time to time. The version published on our website at the time a contract is formed will apply to that contract. We encourage you to review these Terms periodically.
